Terms & Conditions DECLARATION and ACCEPTANCE OF TERMS

I am/We are duly authorised and acting on behalf of the above Applicant, apply hereby for credit facilities with Clear Thinking Marketing cc (hereafter “CTM”) accept and confirm irrevocably that all transactions between Applicant and CTM, past and present, will be subject to the following terms and conditions:
  1. Quoted advertising rates are net of VAT and are subject to cancellation at the sole discretion of CTM.
  2. In event of cancellation by CTM, any money paid in respect of an advertisement which has been cancelled will be returned;
  3. Cancellation on the side of the Advertiser will construe proper cancellation, only when a written notice has come to the attention of CTM, before the Booking Deadline and Artwork Deadline for each issue, available on www.themonth.co.za . CTM will place advertising in the relevant publication each month unless instructed otherwise by the Advertiser.
  4. Orders for publication must be made before the Booking Deadline and Artwork Deadline for each issue. The mere fact that CTM received the order or payment before the deadline must not been seen as an undertaking that any advertisement will be published on any specified date or at all and CTM has absolute discretion as to whether to accept or include an advertisement , advertorial or loose insert in any issue.
  5. CTM shall be entitled to withdraw any credit facilities approved at any time without prior notice, and the balance then due and outstanding to CTM, will become immediately due and payable on demand.
  6. CTM may, without reference to the Advertiser, make any alteration in an advertisement to ensure its conformity with the standards of the relevant publication;
  7. The Advertiser indemnifies the CTM against all liabilities, claims, costs and expenses of whatsoever nature arising directly or indirectly from the publication of any advertisement.
  8. All accounts shall be paid punctually within 30 days after date of account is rendered where after interest shall be charged at 1.5 % per month.
  9. The information and particulars given in this Application are true and correct and CTM shall be authorised to verify the correctness thereof and to contact offered trade references for further information relating to the Applicant’s credit worthiness.
  10. I/We consent to the jurisdiction of the Magistrate Court with respect to any matters between the Applicant and CTM, notwithstanding the fact that the amount of the claim may exceed the jurisdiction limit of the Magistrate’s Court.
  11. The Advertiser chooses the address indicated above as domicilium citandi et executandi with respect to any proceedings which may relate to this Application.
  12. The Advertiser shall be liable for payment of all attorney/own client cost, plus collection commission, should CTM incur such cost to collect payment of the account in arrears, or in order to enforce his rights otherwise in terms of this agreement.
  13. A certificate signed by the Editor of the relevant publication, shall be prima facie proof of the amount and interest for purposes of judgment, including provisional or Summary Judgment. It shall not be necessary for CTM to prove the appointment of authority of the manager signing such certificate.
  14. By confirming a booking or making payment an advertiser is deemed to have agreed and accepted these conditions.
  15. By ticking the acceptance box, the party(ies) making this application, bind himself/herself/themselves by such action to CTM for the punctual performance of all obligations of the Applicant, jointly and severally to CTM, with respect to any amount present or amount which may become due in the future, which the Applicant is or may be due to CTM for any cause whatsoever. The party(ies) making this agreement further waive(s) the privilege of the legal exceptions of excussion, splitting of claims, and devision, and further declare hereby that he/she appreciates and understand the meaning thereof. This suretyship(s) shall be a continuous suretyship, and shall only be cancelled in terms of a written agreement signed by both surety and CTM.
